Joey Ryan, real name Joseph R. Meehan, had another case dismissed against three “Speaking Out” accusers.
It happened on Wednesday by Judge Michael W. Fitzgerald. This lawsuit was filed last summer. The judge stated Meehan “has not adequately responded to the OSC,” according to court documents obtained by HeelByNature.com. It should be noted that “a district court has authority to dismiss a plaintiff’s action due to her failure to prosecute and/or to comply with court orders.”
Now, Ryan can make the decision to re-file as long as the statute of limitations hasn’t run out. This comes after Ryan had won a default judgment against a woman who failed to respond to a complaint, which now allows the defendant the option to file a motion to have the default set aside.
This would see her have the choice to move forward with the case, but a valid reason would need to be provided as she didn’t give a response in a timely fashion.
