San Luis Potosí Prosecutors Open Domestic Violence Investigation Against Alberto Del Rio

The Fiscalía General del Estado de San Luis Potosí, the state prosecutor’s office in San Luis Potosí, Mexico, has officially opened a criminal investigation against former WWE Champion Alberto Del Rio on a charge of violencia familiar (domestic violence) following his arrest on Monday April 6.

In a statement posted to its website on April 7, the office confirmed that Alberto “N” (Mexican law refers to accused individuals by first name only in public statements) is accused of physically and verbally assaulting his partner at a residence in the Lomas del Tecnológico neighborhood in the capital city of San Luis Potosí. The alleged victim placed a call for help on the afternoon of April 6, and agents of the Guardia Civil Estatal responded and detained Del Rio in flagrancia, meaning he was caught at the scene while the alleged offense was still in progress or immediately after.

Del Rio was transferred to the Fiscalía Especializada en la Atención de la Mujer, la Familia y Delitos Sexuales, a specialized unit that handles crimes against women, families and sexual offenses. Prosecutors will complete the investigation file and present Del Rio before a judge at an initial hearing.

Per Milenio, the alleged victim sustained injuries to her face and arms. Infobae México has identified her as Del Rio’s wife, Mary Carmen Rodriguez Lucero, who is reportedly under medical and legal protection.

Milenio has also reported on the potential sentencing range under the San Luis Potosí criminal code. A conviction for the baseline charge of violencia familiar carries one to seven years in prison. A more serious charge of lesiones cometidas contra la mujer en razón de su género (injuries committed against a woman on the basis of her gender) carries eight to 20 years. That charge applies in cases involving degrading or severe injuries, mutilation, or a prior pattern of threats, harassment or violence.

This is not Del Rio’s first encounter with domestic violence allegations. In May 2020, he was arrested in San Antonio, Texas, and the Bexar County District Attorney’s office charged him with aggravated kidnapping and sexual assault. The case was dropped after the witness (the victim) refused to testify. Prior incidents involving his then-partner Saraya-Jade Bevis (Paige) in 2017 and 2018 were reported but did not result in formal charges.

Del Rio, whose real name is José Alberto Rodríguez Chucuán, is 48 years old. He has not been convicted of any crime in this case and is presumed innocent under Mexican law.
