Following the news of Alberto Del Rio’s signing with WWE (as part of the AAA acquisition), there has been some misinformation online on Alberto’s 2021 case.
The allegations, which included aggravated kidnapping and sexual assault, were dropped when a key witness failed to appear for trial.
Del Rio (José Alberto Rodríguez Chucuan) was arrested in San Antonio, Bexar County, in May 2020. According to police affidavits and reports from the time, an ex-girlfriend accused him of a prolonged assault that began after he accused her of infidelity. When she denied the accusations, he allegedly slapped her “across the head” multiple times. Reports further detailed that he allegedly forced her to wear a dress and dance for him, threatening to “take her son and drop him off in the middle of the road somewhere” if she began to cry.
The police affidavit further alleged that Rodríguez Chucuan then tied the woman’s hands with boxing straps, put a sock in her mouth, and sexually assaulted her for several hours, reportedly using various objects during the assault. It was also reported that he punched her in the back. Responding officers at the time noted in their reports that the accuser had visible injuries, including bruises on her face, arms, legs, and neck, which were photographed as evidence. Additionally, the accuser alleged that Rodríguez Chucuan smashed her cell phone and laptop and attempted to burn her passport.
Following these allegations, a grand jury indicted Rodríguez Chucuan in October 2020 on one count of aggravated kidnapping and four counts of sexual assault.
After several postponements, the trial was scheduled to begin in December 2021. However, on December 10, 2021, all charges against Rodríguez Chucuan were formally dropped. The Bexar County District Attorney’s office confirmed at the time that the case could not proceed because a crucial witness for the prosecution, the accuser, was missing or failed to appear for the trial.
The dismissal of the charges legally cleared Rodríguez Chucuan in connection with this case. He had maintained his innocence throughout the proceedings. More on this story at this link and here.
