WWE Is Not Done With a Fan Lawsuit Over WrestleMania Pyro

Although WWE had a fan lawsuit dismissed against them from Marvin Jackson alleging that he suffered injuries while attending WrestleMania 38 in Dallas, the company is still not done with it.

The lawsuit was filed this past January in Texas, where he alleged that he lost hearing in his left ear while an “invitee” to WrestleMania 38 due to pyrotechnics that was part of the event production.

As a result, he wanted a jury trial for monetary relief of more than $1,000,000, including damages of any kind, penalties, costs, expenses, prejudgment interest, and attorney’s fees.

Pwinsider reports that court documents show he filed a notice of appeal on May 11 with The United States District Court for the Northern District of Texas, Fort Worth Division.

This is after United States District Judge Mark T. Pittman sided with WWE’s previous request that the lawsuit should be moved from The United States District Court to arbitration.

The court previously dismissed the lawsuit with prejudice. Typically, this means someone cannot bring the lawsuit back to life before the same court.
